Even though you are eligible to become the sponsor for your foreign spouse to live in Indonesia, he/she is not allowed to work in Indonesia. Therefore, he/she needs to have the Indonesian KITAS work visa. Before obtaining this visa, your foreign spouse needs to have a work permit in Indonesia or Izin Mempekerjakan Tenaga Kerja Asing (IMTA). Here are the types of Indonesia KITAS, the regulation about the use of foreign worker in Indonesia, and the procedures to obtain the Indonesian KITAS work visa.

Types of Indonesian KITAS

There are two types of Indonesian KITAS. They are:

- Indonesian KITAS Marriage Visa

Indonesian KITAS marriage visa only allows your foreign spouse to reside in Indonesia. You can only become the sponsor to your foreign spouse and will obtain the KITAS family visa. 

- Indonesian KITAS Work Visa

Indonesian KITAS work visa can be obtained if your foreign spouse is sponsored by the registered organization or company in Indonesia such as the representative office, Indonesian-owned company, or private institution. To obtain this type of KITAS, your foreign spouse needs to obtain the IMTA.

Presidential Regulation Number 20 2018 on the Use of Foreign Worker The recent update on the Presidential Regulation Number 20 2018 on the Use of Foreign Worker was issued on March 29, 2018. The purpose of this recent regulation is to support the Indonesian national economy by simplifying the foreign workers who want to obtain the Indonesian KITAS work visa and work permit so that they can do more the investment and work in Indonesia.

The Procedures to Obtain Indonesian KITAS Work Visa

To be able to work legally in Indonesia, your foreign spouse must obtain the Indonesian Kitas work visa and work permit (IMTA). If your foreign spouse obtains that, he/she will obtain the limited stay permit visa and card (VITAS and KITAS). To obtain IMTA, some procedures in accordance to the recent Presidential Regulation (No. 20/2018) on The Use of Foreign Worker can be followed.

1. He/she needs to get the Foreign Manpower Employment Plan Approval or Rencana Penggunaan Tenaga Kerja Asing or shortened RPTKA which is issued by the Ministry of Manpower of Indonesia unless he/she works as the representative of the foreign countries, the international organization, the government institution, the consular or diplomat that works in the representative office in the foreign countries, the shareholder or the commissioner that are appointed by the company, and foreign worker in certain position in the government. 

2. He/she needs to have the pre-working permit (Pre-IMTA), in which during the process he/she will figure out the length of the stay in Indonesia based on the work position in Indonesia.

3. He/she needs to pay the development funds monthly to the Ministry of Manpower or DKP-TKA for USD100 per month, and the payment must be paid in advance based on the length of the working period in Indonesia.

4. He/she can obtain IMTA and can work legally in Indonesia.

5. He/she can proceed to Indonesian Immigration to have the issuance of VITAS, and the VITAS validity will be by the work position he/she has.

6. Once he/she enters Indonesia, the VITAS must be converted into KITAS. Your foreign spouse Indonesian KITAS work Visa can be obtained.

7. He/she needs to go to the Indonesian Immigration to have the biometric data recorded. 

8. He/she also can obtain multiple entry and re-entry permit or MERP, in which can be used to exit and re-enter Indonesia and is valid as same as KITAS.

9. By the time he/she resides in Indonesia, you and your foreign spouse need to obtain the civil registration and provides all the documents needed to live in Indonesia. 

As the 2018 regulation is valid, your foreign spouse can easily obtain the Indonesian KITAS work visa and can work legally in Indonesia if he/she follows the procedures.
